Privacy Commitment
The Clarke Partnership is committed to protecting your privacy and keeping your personal information
confidential and secure. This privacy notice explains how we collect and use your personal information in
accordance with General Data Protection Regulation.

The lawful bases for collecting and processing your data
The personal information we request is necessary to provide legal services to you, your insurer and to comply
with regulation as applicable. The Firm is required to process your personal data fairly and lawfully and only
processed if certain lawful bases for the processing are met, are adequate, relevant and not excessive in relation
to the purpose(s) for which it is processed.

We collect your personal data on the lawful basis of your contractual terms with your insurer and/or your contract
with us. We may require additional sensitive information to support your claim, such as medical or financial
information, we will only collect this type of data with your explicit consent to disclose.
Failure to provide the relevant data would mean that we are unable to continue to provide contractual legal
services to you.

Data Sharing
The Firm may share your personal data with relevant third parties on your behalf during the administration of your
claim, these may include; your insurer, your opponents representative, professional experts to support your claim
and judicial courts to assess your claim. The Firm may also be required to share your data to comply with
regulation and law enforcement authorities if legally bound.
The Firm utilises external UK companies to provide systems to administer and process your data, we ensure they
meet our stringent security requirements and comply with the General Data Protection Regulation. Details of
these companies are available by request to the Firm’s Governance and Compliance Officer.

The Firm does not disclose your data to any other organisation for marketing or promotional purposes.

General Data Protection Regulation
The General Data Protection Regulation aims to protect the rights of individuals about whom personal information
is processed. In order to comply with the regulation the Firm is required to be registered as a Data Controller with
the Information Commissioners Office which is an independent UK Parliament authority that enforces and
oversees the General Data Protection Regulation.
The Firm maintains security of your personal data in line with industry standards and practices, however if you
suffer loss or damage because we do not comply with the General Data Protection Regulation, you may be
entitled to compensation and have the right to lodge a complaint with the Firm Complaints Manager; and the Information Commissioners Officer;
Our obligations to you

The Firm must ensure that your personal information is:-

· processed in accordance with your rights under General Data Protection Regulation

   Act on your regulatory rights to object, restrict or withdraw consent to processing your data and your
right to erasure of your data; it should be noted in some circumstances legal exemptions apply to
these rights
·   In certain circumstances you have a right to request portability of your data to another data controller
·   Accurate and, where necessary, kept up to date

·   Kept for no longer than is necessary for the purpose(s) for which it was collected,
this retention period
is specified as 6 years from our last correspondence with you, in accordance with
the Firm’s Data
Protection Policy

·  Protected by appropriate technical and organisational measures against unauthorised or unlawful
processing or accidental loss destruction or damage.

·    Update you on any changes to our Privacy Notice

·  All of your data is located in the UK, if this changes we will notify you before any changes are implemented

Your obligations
To the best of our ability we aim to ensure that the personal data we hold is accurate and up-to-date, it is your
responsibility to update the Firm if any of your personal information changes. If you identify that the data we hold
is inaccurate you have a regulatory right to rectification and you must notify the Firm to request amendments to
your personal data records to ensure security of your personal information

Your right of access
You may obtain a copy of the personal information the Firm holds about you during your relationship and after
your relationship ceases for up to 6 years, these are your regulatory rights under the General Data Protection
Regulation called a Subject Access Request, we will provide copies of your data within one calendar month from
your formal request.
To action this right you are required to complete the Firm’s Subject Access Request form, which you can obtain
from the Governance and Compliance Officer :-
